🗝️ A Few Key Points

• We have an Exclusion of Liability clause: You use the Website and Products at Your sole risk.
• Sharing audio of poem recitations that are not already on my Youtube channel is against my Copyright Policy ⇒ Share small, written quotes of poems that aren’t on my Youtube.
• Breaching these Terms (including by not following strong password requirements) will terminate access to Your Account, losing access to Your purchases.
• Due to the digital nature of my E-Books, there are no refunds for any reason.
• You are responsible for keeping strong and confidential login info, to protect my E-Books.

Introduction

Our Terms and Conditions are effective as of 3/30/2025.

This Agreement is between Users and Customers of hopenotless.com, and Hope. Not Less. (owned by Margot Emmeline). 

These Terms and Conditions outline the boundaries regarding Your use of the Service or Products.

Please read these terms and conditions carefully before using Our Service or Products.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

By accessing or using the Service or Products You agree to be bound by these Terms and Conditions. Accessing or using the Service or Products may look like visiting the Website, creating an Account, and/or purchasing a Product. If You disagree with any part of these Terms and Conditions then You may not access the Service or Products.

Your access to and use of the Service or Products is also conditioned on Your acceptance of and compliance with the No Refunds Sales Policy. By accessing or using the Service or Products You agree to be bound by the No Refunds Sales Policy. 

Your access to and use of the Service or Products is also conditioned on Your acceptance of and compliance with the Privacy and Cookies Policy. Our Privacy and Cookies Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website.

Before submitting a purchase  or creating an Account, Customers are required to check a box affirming that they agree to these Terms, the No Refunds Sales Policy, and the Privacy and Cookies Policy.

Exclusion of Liability

In no event shall the Company be liable for any losses or damages whatsoever, whether special, incidental, direct, indirect, exemplary, punitive, consequential, or otherwise (including, but not limited to, loss of data or other information, personal injury, injury to another person, technological malfunctions or failures, loss of privacy) arising out of or in any way related to the use of or inability to use the Service or Products, third-party software and/or third-party hardware used with the Service or Products, or otherwise in connection with any provision of these Terms and the policies linked herein– even if the Company has been advised of the possibility of such damage.

The Company makes a good faith effort to protect its Customers through Trigger Warnings, Maturity Warnings, Medical & Health Disclaimer, and Crisis Resources on the footer of each web page, applicable sales pages, and within applicable Books; As well as through enforcing strong passwords and a reputable cookie consent management platform. 

Before submitting a purchase or creating an Account, Customers are required to check a box affirming that they agree to these Terms (including the Risks & Results clause where You agree to assume all risks), the No Refunds Sales Policy, and the Privacy and Cookies Policy.

If You are dissatisfied with Our Service or Products, Your one exclusive solution is to stop using the Service and Products without refund.

User Accounts

Account Termination & Product Access

Your access to the Product is solely through and contingent upon access to Your online Account. 

For example, if You breach these Terms or do not want Your data stored with Us anymore, We will terminate Your Account and You will therefore permanently lose access to Your purchased Products without refund.

My Library Links are Confidential

You are prohibited from sharing any links and login info found in the Bookshelf of Your My Library Account, or else We will terminate Your Account and You will therefore permanently lose access to Your purchased Products without refund.

How You Must Keep Your Account Secure

It is Your responsibility to keep Your username and password confidential, and ensure that your password meets all the criteria listed at login, to protect the Products You access through them. Problems with this may cause Us to change Your password, or suspend or terminate Your Account: thereby forfeiting access to Your purchase without refund.

You are responsible for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your Account. You agree not to share Your login credentials: only one User is allowed per Account. Only 2 Devices are allowed per Account.

Accurate & Appropriate Account Information

When You create an Account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your Account on Our Service or Products.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Intellectual Property Warning

The Service and Products, and all their Content (including but not limited to: Books, logo, brand name, slogan, community name, all text, quotes on images, image arrangements, video and audio, and the design and presentation thereof) is owned exclusively by Margot Emmeline, and is protected by United States and international copyright and trademark law. The individual stock images themselves and Content clearly attributed to others are excluded from this copyright claim. 

The internet makes it easy to know when work is infringed.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Copyright Warning: How You May & May Not Share Content

You may share small written quotes from the Books non-commercially, if You credit Hope. Not Less. as the source; include hopenotless.com, or correct Hope. Not Less. social media handles below.

You may NOT share audio or video from poems that I have not put on my Youtube channel; You can only share my existing Youtube videos if You want to share a poem recitation as opposed to a written quote. This means no posting my poem recitations that are exclusively in my Books, and no posting Your own recitation of my poems (because it is so easy for online Content to be misattributed to the latest person who performs it).

Entering Your email in exchange for a free Book, or Your receipt of purchase of a paid Book, allows You one legal copy in Your hopenotless.com Account, for Your own personal non-downloadable, non-printable, & non-commercial use. The Books stay in Your Account, prohibiting downloading, printing, embedding, or any action that makes a copy or shares the Books.

Screenshots, pictures, screen recordings, or their equivalents, are not permitted.

You cannot adapt, modify, publish, sell, lend, distribute, or reproduce (for free or otherwise), in any media or form or by any means, the whole or any part of the Service or Product, without the prior written consent of Margot Emmeline.

Use for religious purposes are not permitted; such as use in relation to any church which makes money by any means, or on websites or social media profiles which are used to make money by any means.

When You make an Account to view my Content, You agree to these Terms which outline the proper use of my Content. This agreement is more restrictive than general proper use of copyrighted materials. Breach of proper use is at the sole discretion of the author, Margot Emmeline. Breach of proper use may include cases not specified in these Terms.

Purchases & Payments

We do not guarantee that Product descriptions or Our other Website Content is accurate or complete.

Delivery of Your purchases– You access Your non-downloadable E-Books through Your hopenotless.com Customer Account.

We accept credit and debit card payments with Our Stripe Payment processor. 

You will be charged immediately upon submitting Your purchase. Splitting up payments is not offered. 

All prices are listed in USD.

We reserve the right to end promotions, discount codes, or sales at any time or reject them after a period of Our choosing.

No Refund Sales Policy

Read Our No Refund Sales Policy, which is displayed on each paid Book’s sales page and Our Website footer. Sufficient information is detailed in this policy for You before purchasing a Book. 

Trigger and Maturity Warnings (including topics being potentially offensive to religious people), Audio Count, Poem Count, the need for earphones at a high volume, and Medical & Health Disclaimer are all disclosed in the FAQs of the sales pages where they apply and in the No Refunds Sales Policy or the pages linked or referenced within. 

All this information can help You determine before purchasing if a Book may be to Your taste, but art is subjective and so satisfaction is not guaranteed. 

Anyone who agrees to these Terms, or accesses or uses the Service or Products, also agrees to the No Refund Sales Policy. 

We offer no guarantees. No refunds for any reason. No exceptions.
